6 Privacy Statement

The AEMC is subject to the South Australian Government's Information Privacy Principles Instruction.      

This privacy statement explains how the AEMC collects personal information through this website, how the AEMC uses and discloses that personal information and how you can contact the AEMC if you have any queries.  This privacy statement does not apply to personal information collected by the AEMC elsewhere. 

a  What is personal information?

Personal information means information or an opinion, whether true or not, relating to a natural person or the affairs of a natural person whose identity is apparent, or can reasonably be ascertained, from the information or opinion.

b  Collection of personal information

The AEMC collects your personal information on this website only when you choose to provide it to the AEMC, for example, if you:

  • lodge a submission containing personal information in the course of one of AEMC's statutory consultation processes (including the Rule Change Process);
  • contact the AEMC through the website with a query; or
  • register to receive AEMC Updates.

c  Information that does not identify You

Some of the information that is collected during your visit to this website is not personal information, because it does not reveal your identity.  For example, the AEMC may record your server address, domain name, the date and time of your visit to this website and the pages that you viewed.  This information is used by the AEMC in anonymous, aggregated form only, for statistical and website development purposes. 

However, the AEMC reserves its right to use or disclose this information to try to locate an individual in the unlikely event that it reasonably believes that the individual may have engaged in any unlawful or inappropriate activity in connection with this website.

d  Cookies

A cookie is a small data file that a website transfers to your internet browser for identification purposes.  The cookies that the AEMC uses do not identify you individually.  Instead, they identify your internet browser.

The AEMC uses cookies to maintain session information about you when you log into the AEMC website, which enables the AEMC to personalise your current visit.

The AEMC will use and disclose the personal information that you have provided to it through the website forms for the purpose for which it was provided (for example, to respond to your query or, where you lodge a submission, for the consideration and publication of the submission, for consideration of the submission within the context of the AEMC's published decisions or determinations and the identification of interested parties that have made submissions). 

In addition, if you have indicated that you would like the AEMC to keep you informed via the AEMC Updates, the AEMC will also use your details to send you information about its activities.    You can let the AEMC know at any time if you no longer wish to be contacted for this purpose.  Your permission will remain current until you advise the AEMC otherwise.  

Your personal information may also be disclosed to the AEMC's contractors and agents (such as consultants, information technology providers, marketing and communications agencies, conference organisers and printers) for the purposes outlined in this privacy statement.

If the AEMC has further dealings with you that require the collection of additional personal information, it will offer you more information about privacy then.

Your personal information may also be used and disclosed for other purposes with your consent, or if those purposes are required or authorised by law.

f  Access

The AEMC is subject to the Freedom of Information Act 1991 (South Australia).  Information about gaining access to your personal information that may be contained in AEMC documents can be viewed on our Freedom of Information page.
