In general, any person (including groups of individuals or organisations) can lodge a rule change request with the AEMC.

General guidelines for preparing a rule change request

The Commission’s formal rule amendment procedure is prescribed in Part 10 of the National Energy Retail Law (South Australia) Act 2011 (NERL).

If you are interested in proposing a rule change, then the documents that you need to lodge must meet the content requirements established in section 246 of the NERL. These content requirements are similar to those that are imposed under the electricity and gas laws.

While the usual process for considering rule change requests follows a statutory (formal) timeframe, there are limited circumstances where the timeframe for a determination (decision by the Commission) may be brought forward. For example, if you can demonstrate that your proposal is non-controversial or is urgent, we may consider your request to expedite the process. Alternatively, if you are lodging a rule change proposal and are defined as an energy regulatory body, then the option of fast tracking your proposal is available to you, provided that public consultation on the matter has been undertaken.

  • Online, via the AEMC’s website; or
  • In hard copy, via ordinary mail.

Submissions

Who can make a submission?

Any person (including groups of individuals or organisations) can lodge a submission on an open rule change request, or review, with the AEMC.

General guidelines for making a submission
