Rule changes: Completed

On 3 December 2009, the Commission gave notice under sections 102 and 103 of the National Electricity Law (NEL) of the making of National Electricity Amendment (Bid and Offer Validation Data) Rule 2009 and its related Rule determination. The Rule determination generally accepts AEMO's Rule proposal, with some amendments. The Rule as made commences on 16 December 2010.

On 29 April 2009, the Australian Energy Market Operator (AEMO) submitted a Rule change proposal seeking to address inconsistencies between schedule 3.1 of the National Electricity Rules (Rules) and AEMO’s current operating practice.

AEMO contended that these inconsistencies have arisen because schedule 3.1 has not previously been reviewed to reflect changes made to the National Electricity Market's (NEM) dispatch and pricing processes which have evolved since market start.

AEMO's Rule change proposal proposed specific amendments to address the following issues:

1. much of the data required under schedule 3.1 of the Rules is now redundant and should be deleted because the information is already provided through alternative procedures or implicit in the bid and offer data;
2. schedule 3.1 should be amended to require Market Ancillary Service (MAS) providers to provide MAS validation data as is currently being done in practice;
3. the term "registered bid and offer data" used to describe the data under schedule 3.1 should be replaced with "bid and offer validation data" to better reflect its meaning; and
4. Market Participants should give AEMO at least six weeks notice for any changes required for existing schedule 3.1 data.

On 11 June 2009, the Commission published a notice under section 95 of the National Electricity Law (NEL) to commence initial consultation on this Rule change proposal.  The Commission also published a Consultation Paper to provide guidance to stakeholders in responding to first round consultation. First round consultation closed on 10 July 2009. 

On 10 September, the Commission published a notice under section 99 of the NEL to commence consultation on the draft Rule and draft Rule determination on this Rule proposal.  The draft Rule determination generally accepted AEMO's Rule proposal, with some amendments.  Second round consultation closed on 23 October 2009
